1. Subject matter
1.1 Images protected by copyright
You are not authorized to publish images from the MAK Collection Online that cannot be downloaded. For inquiries regarding the use of these images, please contact repro@MAK.at.
1.2 Public domain images
You are entitled to download and freely use images from the MAK Collection Online that are provided under the Public Domain Mark 1.0 Universal license. The corresponding rights notice is displayed when you click on the download symbol for a public domain image.
1.3 Images protected by copyright that are released for download
You are entitled to download the images of the MAK Collection Online that are protected by copyright and that the MAK – Museum of Applied Arts (hereinafter referred to as “MAK”) provides as the rights holder under the CC BY-NC-ND 4.0 license and to use them under the following conditions. If you use the images of the MAK Collection Online published under the CC BY-NC-ND 4.0 license, you accept these terms of use.
2. Scope of the permission to use the images of the MAK Collection Online protected by copyright and provided under the CC BY-NC-ND 4.0 license
The MAK grants you a worldwide, free, non-exclusive license for the non-commercial use of the images of the MAK Collection Online under the following conditions. The MAK reserves the right to revoke this license at any time.
It is expressly forbidden to use the MAK’s images for any purpose other than those specified here. In particular, the use of the content for commercial purposes requires the express permission of the MAK. Please direct any inquiries in this regard to repro@MAK.at.
Any unauthorized commercial or non-private use of the content presented constitutes a serious breach of copyright, which may be prosecuted under civil and criminal law and may give rise to claims for injunctive relief and damages on the part of the MAK.
3. Terms of use
The non-commercial use of the images of the MAK, which are provided under the CC BY-NC-ND 4.0 license, is subject to the following conditions:
- The rights holder “MAK – Museum of Applied Arts” must be indicated directly with each image used from the MAK Collection Online. In the case of the simultaneous use of content from several rights holders, an assignment of the MAK content to the content used must be ensured.
- The rights notice can be found in the information displayed before downloading the image (section Rights Notice) and must be attached directly to the content.
- Edited versions of the content used may not be distributed. If you remix, modify, or otherwise build directly on the material, you may not distribute the edited version of the material without the permission of the MAK.
- Restriction of the rights of the content used is not permitted. You may not use any additional clauses or technical procedures that legally prohibit others from doing anything that the license permits.
Any violation of the conditions shall result in the automatic revocation of the authorization of use and shall trigger claims for injunctive relief and damages on the part of the MAK.
4. Exceptions
The present authorization of use does not cover the use of
- Personal data
- Information that has not been published
- Word and design marks of the MAK
- Rights of use of third parties to which the MAK holds no rights
- Personal documents
5. Disclaimer
The MAK assumes no liability for the topicality, correctness, completeness, or quality of the information provided. Liability claims against the MAK relating to material or non-material damage caused by the use or non-use of the information provided or using incorrect or incomplete information are fundamentally excluded, unless there is evidence of gross negligence on the part of the MAK.
All offers are subject to change and non-binding. The MAK expressly reserves the right to change, supplement, or delete parts of the pages or the entire offer without prior notice or to cease publication temporarily or permanently.
6. Place of jurisdiction and choice of law
These Terms and Conditions shall be governed in their entirety by Austrian law, except for its conflict of law rules. The place of jurisdiction is Vienna/Innere Stadt.
